CCI Rejected Complaints Against Shopee, Amazon

The CCI has dismissed complaints against Shopee and Amazon, stating that the two companies did not engage in anti-competitive practices. Singapore-based Shopee has come across allegations of abusing its dominant position in the market for online marketplace services in India. The CCI, however, did not find any evidence to support these allegations.
Similarly, Amazon was also accused of using its dominance in the e-commerce sector to favor its products and services. Amazon used data of successful sellers to its advantage to sell private-labeled products.
Various Allegations of Competition Norms Against Shopee
Shopee has been offering heavy discounts on products, which is allegedly aimed at driving other small businesses out of the market. In response to the allegations, Shopee said that it does not indulge in any unfair practices and offers discounts to attract more customers.
Shopee entered the e-commerce sector in India in November 2021, while Amazon has been present in the country since 2013. With Shopee’s entry, the Indian e-commerce market turned competitive. One of the complainants mentioned that Amazon was using its dominant position in the eCommerce sector to favor its own products and services. It was also alleged that Amazon was using data of successful sellers to its advantage to sell private-labeled products.
The complainants noted that predatory pricing was performed to impact the smaller businesses in the market. An Amazon spokesperson said that the company welcomes the decision of the CCI and will continue to focus on providing high-quality and convenient shopping experiences to Indian customers.
"We are pleased with the ruling by Competition Commission of India (CCI) which dismissed all allegations against Amazon India. We remain focused on providing high-quality and convenient shopping experiences to our customers in India," the spokesperson said. CAIT has previously objected to Shopee being excluded from the list of 54 Chinese apps, which were banned by the government on the grounds of national security. CAIIT is arguing that the ban should be extended to include Shopee as well.
